The trial court entered a judgment "dismissing" the plaintiff's action for "battery" against Brian Dailey. The plaintiff disagreed with the trial court and filed an appeal. The case is now before the Washington Supreme Court to decide whether or not the trial judge ruled correctly.

The trial court determined, based upon its fact findings after hearing all of the evidence presented by both parties, that Brian Dailey did not have the requisite INTENT to commit the tort of "battery" as alleged in the plaintiff's complaint against him.
